Promotion of Access to Information Act (PAIA)

You may remember an Act called the Promotion of Access to Information Act (PAIA)? Well like most Acts, they don't just go away. This is to remind you that by the 31st December of EACH year, you need to ensure you have submitted a revised version of your PAIA manual.

Another lovely bit of red-tape you may exclaim.

Anyway, here are the guidelines to assist with the development of your manual in terms of section 51.

In terms of s51 of PAIA, the head of a private body must:
- compile a s51 manual which is a roadmap of the company
- submit the manual to the South African Human Rights Commission once per annum;
- update any material changes on the manual on a regular basis;
- make the manual available as prescribed by the Act at the company offices and on their website;
- annex a request form to the manual and also make request form available on the website and at the company premises and access points;

Your manual may be submitted to either Mr. Van Rensburg on email:, or Mr. Moola on email: at the South African Human Rights Commission PAIA offices.

Please note a hard copy of your manual signed by your Information Officer must also be sent to their offices.

The manual must among others contain the following information:
a) details of the company’s postal, email and street address, fax and phone of the company,
b) the description of available records generated by the company stating those which are automatically available and those that are available on request.
c) outline the request procedure in terms of PAIA;
d) state the head of the company (Information Officer in terms of PAIA)
e) stipulate the fees applicable as legislated by the Act which are chargeable to requestors
f) remedies available to requestors if their request for information has been refused
g) details facilitating request for access to a record etc.

Below we have included a copy of the legislation, a guide on how to compile a section 51 manual, a copy of a form C for making a request, fee structure, an example of a completed manual as well as the exemption table in terms of the moratorium for compliance passed by the Minister of Justice and Constitutional Development in 2005 .
